By accessing or using our platform, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must discontinue use immediately. Your continued use of Genpixl.com constitutes your acceptance of these terms.

You must be at least 18 years of age to use our services. By using Genpixl.com, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

Genpixl.com provides an AI-powered platform that allows users to generate images, cards, logos, and other visual content based on text prompts and uploaded reference images. The AI models used to generate content are operated by third-party providers. We do not guarantee the accuracy, originality, or fitness for a particular purpose of any AI-generated output.

AI-generated results may vary significantly between sessions, even with identical inputs. We do not guarantee that any specific result will be reproducible.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. Users will be notified of significant changes. Continued use of the service following any changes constitutes acceptance of the updated terms.

By uploading any image, photograph, logo, artwork, or other visual content ("Uploaded Content") to Genpixl.com, you represent, warrant, and guarantee that:

• You are the original creator and copyright owner of the Uploaded Content, OR
• You have obtained all necessary rights, licenses, consents, and permissions from the copyright holder(s) to upload, use, and process the content on our platform, AND
• The use of the Uploaded Content on Genpixl.com does not infringe, misappropriate, or violate any third-party intellectual property rights, privacy rights, publicity rights, contractual rights, or any other rights.

By uploading content to our platform, you grant Genpixl.com a non-exclusive, worldwide, royalty-free license to process, transform, and use your Uploaded Content solely for the purpose of providing the requested AI generation services. We do not claim ownership over your Uploaded Content and will not use it for any other purpose without your explicit consent.

You may NOT upload content that:

• Belongs to a third party without their express permission (e.g., celebrity photos, branded logos, copyrighted artworks, stock images without appropriate license).
• Contains personally identifiable information of other individuals without their consent.
• Contains images of real people intended for face-swapping, deepfakes, or unauthorized identity manipulation.
• Is protected by trademark and you do not have the right to use it commercially.
• Depicts minors in any inappropriate or exploitative manner.
• Is sexually explicit, pornographic, or sexually oriented in nature, including any content intended to be used as NSFW material.
• Violates any applicable law or regulation.
• Contains explicit, hateful, discriminatory, violent, or otherwise objectionable material.

You agree to indemnify, defend, and hold harmless Genpixl.com, its operators, affiliates, and employees from and against any claims, liabilities, damages, losses, and expenses — including legal fees — arising out of or in any way connected with your breach of the representations in Section 3.1, or from any claim by a third party that your Uploaded Content infringes their rights.

Subject to your compliance with these Terms, you retain ownership of the final images, logos, cards, and other visual assets generated through Genpixl.com using your inputs ("Generated Output"), to the extent permitted by applicable law.

The legal status of AI-generated content and its copyright protection is an evolving area of law that varies by jurisdiction. Genpixl.com makes no representations or warranties about the copyright status or protectability of any Generated Output. You are solely responsible for consulting legal counsel regarding the use of Generated Output in your specific jurisdiction.

You grant Genpixl.com a non-exclusive license to store and display your Generated Output solely to provide and improve our services. We will not sell or license your Generated Output to third parties without your consent.

You may use your Generated Output for commercial purposes (e.g., logos, marketing materials, products), subject to the license tier you have purchased and provided that your use complies with all applicable laws and does not infringe third-party rights.

Users are expected to engage in respectful and lawful behavior on our platform. You may not use Genpixl.com to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

You may not use our AI tools to generate content that infringes on third-party trademarks, replicates copyrighted logos or artworks without authorization, or is intended to deceive or mislead others. Furthermore, the creation of face-swaps, deepfakes, or any form of unauthorized facial or identity manipulation of real individuals is strictly prohibited.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@genpixl.com of any unauthorized use.

Users agree to pay the specified fees for our services. All prices are displayed on our pricing page and are subject to change. Payments are processed securely by Creem.io.

Subscription fees are billed on a recurring basis. One-time purchases are charged at the time of purchase. You agree to provide accurate and complete billing information.

Due to the nature of AI-generated content and instant digital delivery, all purchases are generally final and non-refundable, except where required by applicable law or at our sole discretion.

Genpixl.com retains exclusive ownership of all intellectual property comprising our platform, including but not limited to our logo, visual design, trademarks, software, algorithms, and website content. Nothing in these Terms transfers any rights in our platform IP to you.

If you provide feedback, suggestions, or ideas regarding our services, you grant us an irrevocable, royalty-free, worldwide license to use and implement such feedback without any obligation of compensation, credit, or attribution.

If you believe that content on our platform infringes your copyright, please send a written notice to support@genpixl.com with the following information: (a) a description of the copyrighted work, (b) the location of the allegedly infringing material on our platform, (c) your contact information, and (d) a statement that you have a good faith belief that the use is not authorized.

Our services are provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that AI-generated output will be free from errors, will meet your requirements, or will not infringe third-party rights.

To the maximum extent permitted by law, Genpixl.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or any AI-generated content.

You are solely responsible for how you use, distribute, or publish any Generated Output. Genpixl.com accepts no liability for any third-party claims arising from your use of Generated Output.

We handle user data as outlined in our Privacy Policy, respecting user privacy and complying with applicable data protection regulations including GDPR and CCPA.

Our use of cookies is governed by our Cookie Policy. You may manage your cookie preferences at any time.

We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated these Terms, uploaded content without the proper rights, generated infringing or prohibited content, or engaged in any fraudulent or harmful activity.

Upon termination, your right to use the service ceases immediately. We may delete your account data and any stored Generated Output. Provisions of these Terms that by their nature should survive termination shall survive, including IP ownership, indemnification, and limitation of liability clauses.

In the event of a dispute, we encourage you to contact us first at support@genpixl.com to seek an informal resolution. If a resolution cannot be reached, disputes shall be resolved through binding arbitration or mediation as agreed by both parties.

These Terms are governed by and construed in accordance with the laws of Argentina. Any legal proceedings shall be subject to the jurisdiction of the courts of Argentina.
